Welcome to Bekalah. These Terms and Conditions ("Terms") govern your use of the Bekalah mobile application and the website bekalah.com (together, the "Service"), operated by Bekalah ("we", "us", "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to create an account. If you are under 18, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. The Service

Bekalah is a Chechen language application offering:

  • Dictionaries, translations, and language learning tools.
  • An object scanner that uses your camera to identify objects and teach the Chechen word for them.
  • Poems, proverbs, and cultural content.
  • Children's content (Bekalah TV).
  • Community features such as favourites and, where available, a forum.

We may add, modify, or discontinue features at any time.

3. Your Account

  • You are responsible for the accuracy of the information you provide and for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • Notify us promptly of any unauthorized use of your account.
  • One person may not maintain multiple accounts for abusive purposes.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Upload or share content that is illegal, hateful, threatening, harassing, defamatory, obscene, or infringes the rights of others.
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service, except as permitted by law.
  • Use bots, scrapers, or automated means to access the Service or collect data from it.
  • Interfere with or disrupt the Service, its servers, or networks.
  • Impersonate any person or misrepresent your affiliation with any person or entity.
  • Use the Service to send spam, malware, or any harmful code.

We may suspend or terminate accounts that violate these rules.

5. User-Generated Content

You retain ownership of any content you submit to the Service (e.g. custom words, forum posts). By submitting content, you grant Bekalah a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute that content solely for the purpose of operating and improving the Service.

You are solely responsible for the content you submit and confirm that you have the right to submit it. We may remove any content that violates these Terms or is reported as harmful.

6. Intellectual Property

The Service, including its code, design, text, graphics, logos, translations, audio, and cultural content, is owned by Bekalah or its licensors and is protected by intellectual property laws. You are granted a limited, non-transferable, revocable licence to use the Service for personal, non-commercial use.

You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission, except where expressly permitted by these Terms or applicable law.

7. Third-Party Services

The Service integrates with third-party services (including Google/Firebase, Supabase, Apple, YouTube, Google Sign-In, Apple Sign-In). Your use of those services is subject to their own terms. We are not responsible for third-party services.

8. Purchases and Subscriptions

If premium features or in-app purchases are offered, they are provided through the Google Play Store or Apple App Store and are subject to their terms. All sales are final unless required otherwise by law or platform policy. Taxes may apply.

9. Updates

We may release updates to the Service from time to time. Some updates may be required to continue using certain features. You are responsible for installing updates through your app store.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at our discretion, with or without notice, if you violate these Terms, pose a security risk, or if we are required to do so by law. Upon termination, provisions that by their nature should survive (e.g. ownership, disclaimers, liability, governing law) will continue to apply.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not guarantee that translations, dictionaries, or any content are free of errors, or that the Service will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the fullest extent permitted by law, Bekalah and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) USD 50.

Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law (e.g. liability for fraud, gross negligence, or death and personal injury).

13. Indemnification

You agree to indemnify and hold harmless Bekalah from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your infringement of any rights of a third party.

14. Changes to the Terms

We may update these Terms from time to time. If changes are material, we will notify you through the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
